OFFICIAL TERMS AND CONDITIONS

Contest Period: 17th October 2025 (10:00) to 31st October 2025 (23:59)

1. ELIGIBILITY

1.1 General Eligibility

• Open to UK residents aged 21 or over
• Excluded: Employees of Kendall Cars Limited, their immediate families, and anyone professionally connected with the promotion
• Entrants must follow Kendall Cars Limited on Facebook
• No purchase necessary to enter
• Entries on behalf of another person will not be accepted
• By entering, entrants confirm eligibility and accept these terms

1.2 Prize Eligibility Requirements

To claim and use the £100 discount, winner must:

• Be aged 21 or over (23 if you are a student)
• Hold a full UK driving licence valid for at least 12 months (foreign licences must be valid for UK driving)
• Have no more than 6 penalty points on driving licence
• Have no serious endorsements (DD, DR, IN, CD codes or similar)
• Meet Kendall Cars Limited standard rental requirements
• Book and complete rental within 6 months of winning (by 3rd May 2026)

2. HOW TO ENTER

2.1 Entry Method

• Follow Kendall Cars Limited on Facebook
• Comment on the official contest post on Kendall Cars Limited Facebook page
• Include your Kendall Cars story as specified in the contest post
• Past customers are encouraged to attach a photo to their comment where possible
• Submit entry between 17th October 2025 and 31st October 2025 (23:59)

2.2 Entry Restrictions

• One entry per person only
• Entries must be submitted via Facebook comment only
• Entries via DM, separate posts, or other methods will not be accepted

2.3 Content Requirements

All entries must be:

• Original content owned by the entrant
• Photos taken by entrant or with permission
• Free from copyrighted material (unless permission obtained)
• Appropriate and compliant with Facebook Community Standards
• Free from offensive, defamatory, or illegal content
• Not disparaging to Kendall Cars or competitors
• Free from third-party personal information without consent
• Non-commercial (no advertising or spam)
• Truthful and not misleading

2.4 Ownership

• Entries become property of Kendall Cars Limited and will not be returned
• Entries may be used for marketing and promotional purposes

3. THE PRIZE

3.1 Prize Description

One winner will be selected to receive a £100 (one hundred pounds) discount off the winner’s next qualifying vehicle rental with Kendall Cars Limited.

3.2 Prize Terms

• Validity: 6 months from 3rd November 2025 (expires 3rd May 2026 at 23:59)
• Application: If rental costs less than £100, discount equals rental cost
• Single Use: Valid for one rental booking only
• Non-transferable: Must be used by winner personally
• No Cash Alternative: Cannot be exchanged for cash or credit
• Subject to Availability: Dependent on vehicle availability at time of booking

3.3 What the Discount Covers

• Applies to base rental rate only

3.4 What the Discount Excludes

• Insurance products
• Additional driver fees
• Fuel charges
• Damage waiver/excess reduction
• Optional extras (child seats, GPS, etc.)
• Delivery/collection fees
• Administration fees
• Any charges incurred during or after rental

3.5 Restrictions

• Cannot be combined with other offers, discounts, or promotions
• Valid at participating Kendall Cars Limited locations only
• Must book directly (phone, website, or in person)
• Standard terms and conditions of rental apply

3.6 Standard Rental Requirements

Winner must be eligible to rent with Kendall Cars Limited and meet all standard rental requirements, including:

• Provide photocard driving licence held for at least 12 months
• Provide DVLA licence check code (for UK licences)
• For non-UK licences: passport required in addition to driving licence
• Have no serious endorsements or penalty points (DD, DR, IN, CD codes or similar)
• Have no more than 6 non-serious penalty points
• Provide proof of address (utility bill or bank statement within 3 months)
• Pass credit/reference checks if required
• Pay deposit using a physical payment card in winner’s own name (credit or debit accepted; American Express not accepted)
• Accept full responsibility for vehicle during rental
• Return vehicle in same condition (fair wear and tear excepted)
• Comply with UK road traffic laws and Highway Code

3.7 Prize Substitution

Kendall Cars Limited reserves the right to substitute the prize with an alternative of equal or greater value if necessary due to circumstances beyond its reasonable control.

4. JUDGING AND WINNER SELECTION

4.1 Judging Process

• Entries close: 31st October 2025 at 23:59
• Judging period: 1st – 2nd November 2025
• Judged by Kendall Cars Limited management team
• Winner selected based on highest score
• In event of tie, Kendall Cars Limited will select winner at its sole discretion
• Judge’s decision is final and binding

4.2 Winner Notification

• Winner announcement: 3rd November 2025
• Notification via:
  • Reply to entry comment on Facebook
  • Facebook direct message
  • Public announcement post tagging winner
• Winner must respond within 7 days to claim prize
• If no response, runner-up will be selected

5. CLAIMING THE PRIZE

5.1 Claim Process

• Winner must respond within 7 days of notification
• Winner will be contacted via Facebook Messenger with instructions on how to claim the prize

5.2 Redemption Process

To redeem:

• Book directly with Kendall Cars Limited (phone or in person)
• Inform staff that you are the contest winner at time of booking
• Complete booking within 6-month validity period (by 3rd May 2026)
• Meet all eligibility requirements (section 1.2)
• Provide proof of identity and driving licence

5.3 Forfeiture

• If winner does not meet prize eligibility requirements at redemption, prize is forfeited
• Runner-up will be selected
• No compensation will be provided
• Winner responsible for all costs not covered by discount

6. PUBLICITY AND CONTENT USAGE

6.1 Promotional Rights

By entering, participants agree that Kendall Cars Limited may use:

• Name and Facebook username
• Photograph and likeness
• Entry content (photo and story)

for promotional and marketing purposes without additional compensation

6.2 Content Licence

Participants grant Kendall Cars Limited a non-exclusive, royalty-free, worldwide, perpetual, irrevocable licence to:

• Use, reproduce, edit, adapt, modify, publish, distribute, and display entry content
• Across all media channels including: social media, website, email marketing, print materials, advertising, vehicle livery
• In any format now known or hereafter developed

6.3 Participant Warranties

Participants warrant that:

• They own all rights to entry content
• All individuals in photographs have given informed consent
• Use by Kendall Cars Limited will not infringe third-party rights
• They have authority to grant these rights

6.4 Content Modification

Kendall Cars Limited may edit, crop, or modify content for marketing purposes while maintaining essential integrity.

7. DATA PROTECTION AND PRIVACY

7.1 Legal Compliance

Personal data processed in accordance with UK GDPR and Data Protection Act 2018.

7.2 Data Collected

• Facebook name/username
• Profile picture
• Entry content (text and photos)
• Any voluntarily provided information

7.3 Legal Basis and Purpose

• Legal basis: Legitimate interests (contest administration) and consent (marketing)
• Purpose: Contest administration, winner selection, prize fulfilment, marketing, legal compliance

7.4 Data Retention

• Personal data (name, contact details): Contest duration plus 12 months for all entrants

• Actions or omissions of Facebook or third-party platforms

8.2 Limitation of Liability

• Liability limited to providing prize as described
• Not responsible for consequential losses, damages, or expenses

8.3 Exceptions

Nothing excludes Kendall Cars Limited’s liability for:

• Death or personal injury caused by negligence
• Fraud or fraudulent misrepresentation
• Any liability that cannot be excluded by law

8.4 Participant Responsibilities

9. GENERAL CONDITIONS

• Participants understand they are providing information to Kendall Cars Limited, not to Facebook or Instagram
• Participants release Facebook and Instagram from any and all liability in connection with this contest

9.4 Legal Provisions

• Governed by English law
• Subject to exclusive jurisdiction of courts of England and Wales
• If any provision is invalid, remainder continues in full force
• These terms constitute the entire agreement
• Entry constitutes full acceptance of terms

9.5 Amendments

Kendall Cars Limited reserves the right to amend terms at any time. Amendments will be published on website and Facebook page.

10. INTELLECTUAL PROPERTY

10.1 Copyright

Entrants retain copyright but grant irrevocable licence as specified in section 6.2.

10.2 Warranties

Entrants warrant:

• Content is original work or necessary rights obtained
• Use will not infringe third-party rights
• Individuals in photos have given consent
• Authority to grant specified rights

10.3 Indemnification

Entrants agree to indemnify Kendall Cars Limited against claims, damages, or expenses arising from breach of warranties.

10.4 Reserved Rights

Contest name, Kendall Cars Limited branding, and trademarks remain property of Kendall Cars Limited.

11. FORCE MAJEURE

Kendall Cars Limited not liable for failure to perform due to circumstances beyond reasonable control including:

• Acts of God (floods, storms, earthquakes)
• War, terrorism, pandemic, epidemic
• Government restrictions or regulations
• Industrial disputes or strikes
• Fire, explosion, accident
• Technical failures
• Failure of third-party suppliers

In such circumstances, Kendall Cars Limited may suspend, cancel, modify contest terms, or extend deadlines.

12. ADDITIONAL PROVISIONS

12.1 Fraud Prevention

Fraudulent entries, automated systems, or manipulation attempts result in immediate disqualification and may be reported to authorities.

12.2 Multiple Accounts

Using multiple Facebook accounts for multiple entries will result in disqualification.

12.3 Age and Identity Verification

Kendall Cars Limited may request proof at any time. Failure to provide acceptable proof results in disqualification.

12.4 Taxes

Winner responsible for any tax liabilities (though none anticipated).
